IMPORTANT NOTE PRIOR TO BOOKING: Since we are a professional, family owned and operated vacation rental company. You will be asked to provide ID during the confirmation process. Up to and including home address, email address, copy of drivers license and/or passport, or any other ID deemed necessary at time of booking. Failure to provide full ID upon request will result in cancellation of booking.

We will send you a reservation confirmation to sign. It will serve as the rental agreement for your stay, instead of Airbnb's house rules. Please send us requested information as quickly as possible. To ensure there are no delays with check-in. We cannot send check-in instructions. Until we receive back the electronically signed agreement and reservation confirmation.

Any declined payments for deposit amount will result in a canceled booking.

There will be NO SMOKING and NO PETS in the home at any time.

This agreement is by and between the PROPERTY OWNER, and rental agent VacationCentralFlorida LLC, a Florida corporation, (Hereinafter referred to as OWNER) and Guest including Guest party above (Hereinafter referred to as GUEST).

1.) PETS. There are to be NO pets in the unit or on the balcony/lanai by Guest at any time. Any Pets found in any units will incur a $500 deep clean fee and guest will face immediate eviction by authorities with no refund of any monies paid.

2.) SMOKING. There is to be NO SMOKING, of ANY KIND, or of ANY SUBSTANCE in the unit or on the balcony/lanai by Guest at any time. Any smoking smell found in any room will incur a $500 deep clean fee, and guest will face immediate eviction by authorities.

3.) UTILITIES. Property Owner is responsible for the payment of all utilities and services during Guests stay, including electric, cable TV, and other local utilities and services. Guests will not purchase any additional TV programs, movies, packages, channels, etc. IF guest tries to purchase any additional items, programs, channels, etc. It will be at the cost and expense of guest.

3a.) HVAC/ Air Conditioning/ Extra Rental Addons: Air Conditioning operates at 73 Degrees Fahrenheit (22 Celsius); Air Conditioning Unit will Freeze and Fail if thermostat is set BELOW 73 degrees Fahrenheit while windows or doors are open when the air conditioning unit is operating regardless of thermostat temperature. If Air Conditioning unit freezes. Guest acknowledges there may not be anything VacationCentralFlorida, LLC can do, until the unit thaws out. Any attempts to erase or tamper/disconnect thermostat or thermostat programming will incur a $200 thermostat reprogram fee. Likewise, any tampering with, or changing of, or resetting internet router or modem settings will incur a $200 Internet reprogram fee. Guest will be responsible for service call and repair fees if AC unit fails due to freezing. Heat operates at 68 Degrees Fahrenheit (23 Celsius). Hot water tanks set at 120 degrees max to prevent burns and scalding. We advise operation at 103 to 108 degrees Fahrenheit.

3b.) POOL HEAT (if applicable) for the townhouse Splash Pool is available at an EXTRA FEE of $17 Per night at the townhouses. IF a house with full pool and hot tub was rented. Pool and spa heat will go up to $25-50 per night of the reservation. Please ask if interested in adding to reservation.

3c.) Pool heat keeps the pool at 82 to 85 degrees Fahrenheit, and operates in temperatures above 50 degrees Fahrenheit. This is an OPTIONAL choice. In the event of pool heater breakdown or other circumstances beyond our control the Owners / Owner's Agent will do their best to rectify the problem ASAP. In such an event liability will be limited to refunding the pool heat money paid by the Guest for the number of days that the heater is out of action only – no other compensation will be paid. Should guest decide after check-in they want pool heat activated, that will require an additional $25 call-out charge (plus the pool heat fee per night). Any unauthorized attempt to activate pool heat by guest and/or unauthorized tampering with pool equipment will incur a pool heat charge of $125 plus an additional $250 fee upon guest check out for pool equipment tampering.

3d.) GRILL (If Applicable at unit). Use of grills not permitted.

4.) HOMEOWNER ASSOCIATIONS, TRAILERS. Guest agrees to abide by all Homeowner Association Rules and requests and VacationCentralFlorida LLC policies and requests with regard to all aspects of entry, accommodation, and rental of the unit. Policies are subject to change at the discretion of VacationCentralFlorida LLC. At no time may a guest bring unsafe equipment, cargo, vehicle(s), trailer(s) or any other unsafe item (as deemed unsafe by VacationCentralFlorida LLC) onto any part of the common property or unit. Guests will not park trailers, over-sized vehicles, boats, RVS, or any other large or oversized vehicle, or trailer on premises of unit, condo, townhouse, or house.

4a.) OCCUPANCY. Guest agrees to not go over the stated unit overnight occupancy. Which is commonly (But not always) 2 per bedroom and 2 in the living area. UNLESS POSTED ON PROPERTY LISTING OTHERWISE. Please check listing for accurate overnight occupancies. Infants count as occupants.

5.) ORDINANCES AND STATUTES. Guest will comply with this agreement, all statutes, ordinances, and requirements of all (county) municipal, state, and federal authorities now in force, or which may later be in force, regarding the use of the premises, including, but not limited to, the use or sale of illicit drugs, smoking marijuana, cigarettes, or other smokable products (including vapes). Failure to abide by this agreement, any local, municipal, state, federal authority or ordinance, including occupancy limit, will result in guest’s immediate eviction by authorities with no return of deposit or payments. Any fines, charges, levies, or assessments by authorities or Condo Association or owner as a result of guest activity or behavior are the sole responsibility of guest.

6. TRAVEL INSURANCE.

Travel Insurance:
Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. We strongly recommend you purchase this valuable protection. 7.) ASSIGNMENT, SUBLETTING, CLOSURES. Guest will not assign this agreement or sublet any portion of the premises. Guest listed above must be the occupying party. On occasion, the HOA will close, limit, or otherwise make some amenities unavailable for use within the property. Owner has no control over HOA closure policies or dates affected and offers no compensation for any closure or maintenance decisions made by the HOA to restrict guest usage or cause inconvenience with regard to any part of the property.

8.) MINIMUM AGE TO RENT. Guest must be 25 years of age to rent from VacationCentralFlorida, LLC.

9.) MAINTENANCE, DAMAGE, ARTICLES, AND REPAIR. Guest acknowledges that, unless the Owner is notified immediately (within a reasonable amount of time- at our sole discretion) upon occupancy, the premises including the furniture, furnishings, appliances, linens, towels, silverware, dishes, cooking utensils, etc. and all other parts and equipment of the rental are in good working order and repair. Any damage occurring to any appliance during Guests stay caused by improper operation or Negligence on the part of Guest will be repaired or replaced at Guests expense (examples: Guest placing clothing with sand, or other damaging material etc. into the washer/dryer, operating AC with windows or doors open, resetting internet connection modem/router settings, freezing up AC unit, overrunning water, breaking plumbing or electrical equipment or outlets, clogging drains, toilets, creating a pool hazard which requires pool to be shocked, treated, drained, repaired, etc.).

9a.) Guest will keep the premises in a clean and sanitary condition, and will immediately notify Owner of any damage to the premises or its contents, or any inoperable equipment or appliances. Any inoperable equipment during guests stay or prior to guests stay will be repaired as soon as practical, local conditions allowing, and no compensation for such will be paid to guest. Guests will check out with the premises in as good condition as received upon check in. Guest is responsible for lost or stolen articles. $45 shipping fee required to return ship an item left behind by guest; in the event it is found. Owner and VacationCentralFlorida, LLC reserves the right to collect payment for damages or replacement from Guest if such damage or loss occurs during guest stay.

10.) ENTRY AND INSPECTION. Owner will have the right to enter the premises during guests stay (a) in case of emergency; (b) to make necessary or agreed repairs, decorations, alterations, improvements, supply necessary or agreed services; (c) when Guest has checked out; or (d) or enter for other reasons deemed appropriate by VacationCentralFlorida, LLC Except under (a) and (c), entry may be made only during normal business hours. Upon checkout, the premises will be inspected and any missing furnishings, equipment, appliances, supplies, or damage to the unit and any such missing equipment or damage will be the responsibility of the Guest.

11.) LIABILITY, NON DISCLOSURE, DISPARAGEMENT AND RELEASE. Guest and Guests party agree that as a result of their stay, prior to, during and following their stay, VacationCentralFlorida LLC, Unit Owner(s) and website will not be liable for any damage, injury, or death to Guest, or any other person(s), or loss or damage of any property, occurring on or in the premises, in or around any pool(s), in any common area, or while in transit to/from the premises. This includes, but is not limited to any loss, damage, injury or death as a result of act of God, declared or undeclared act of war, terrorist attack, act of nature, criminal or mischievous activity, accident, guest medical condition known or unknown, contact with or while in, or on, a motor vehicle, bicycle, wheelchair, scooter, or other means of transportation, other guest, employees and contractors, while operating, or the failure of, any related or unrelated equipment or property, guests contact with plant, animal, insect, reptile, allergen, mold, bacteria, fungi, virus, chemical, gas, fire, liquid, pathogen, person, or any other thing or environment which may cause Guest or Guests party any damage, injury, suffering, loss, or death. Owner is not responsible for any existing or unknown Guest health condition and accepts no responsibility for such. In addition, for valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Guest does hereby remise, release, and forever discharge VacationCentralFlorida LLC, website, websites owner, agents and assigns, VacationCocoaBeach.com and VacationCentralFlorida.com, any owner(s) of any website(s) indirectly or directly promoting units(s), VacationCocoaBeach.com and VacationCentralFlorida.com unit(s) owners ("Owner"), Owner’s agents, servants, successors, heirs, executors, administrators and personal representatives, of and from all, and all manner of, actions, causes of action, suits, proceedings, debts, dues, judgments, damages, claims, and demands whatsoever in law or equity, which Guest ever had, now has, will have in the course of their stay or in the future, or which Guest’s agents, heirs, executors, administrators or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause, or thing whatsoever, past, present, or future.

11a.) Guest and Guests parties, families, and Guest retained third party agents agree they will not disclose, publish, publicize, or disseminate, or cause to be disclosed, published, publicized or disseminated, any information relating to the contents of this agreement or Guests stay. Guest, their parties, families, and/or third party agents agree that before, during, after, or following termination of this agreement, that they will make no statement, written or oral, about VacationCentralFlorida LLC, any of its employees, contractors, units, websites, company practices, or details regarding current, future or past stays and opinions of such, unless specifically approved in writing by VacationCentralFlorida LLC. It is agreed and accepted that Owner is under no obligation to respond to any third-party agent retained by Guest.

12.) DEPOSIT. As Specified on Airbnb.

13.) CANCELLATION. As Specified on Airbnb.

13a.) VacationCentralFlorida, LLC may at any time deem the unit uninhabitable, for any reason. If guest is occupying the unit. Guest agrees to vacate the premises and will be refunded for the portion of unused nights. In the event of any party, or event deemed appropriate by VacationCentralFlorida, LLC staff. Guests may be evicted at the assessment of company staff. If unit becomes uninhabitable prior to guest’s arrival or during stay, we may choose to relocate guest into a unit of equal or better accommodation, or fully refund Guest for unused nights and cancel the agreement.

14.) CHECK IN, CHECK OUT. The unit will be undergoing maintenance, cleaning, and/or inspection up until the agreed to check-in time on the listing. Cocoa Beach, Cape Canaveral (Brevard County) properties have a 4 PM check-in time. Disney/ Kissimmee area properties have a 3 PM check-in time. Any arrival prior to the posted arrival time will be charged an $50 EARLY CHECK IN FEE. Guest agrees to vacate rented premises no later than 10AM on Check Out Day. Failure to vacate at agreed time results in immediate $50 LATE CHECK OUT FEE and forcible eviction by authorities.

14a.) Depending on vacation rental booked. Guest may purchase early check-in for $50 and after payment is received. Guest will be allowed to arrive 2 hours earlier than the agreed to check-in time. Early arrival only once guest has paid fee. Guest may also purchase a late check-out for $50 and may stay in the unit until 12 PM on their day of checkout, once payment has been received for the late departure fee.

15.) Act of God (HURRICANE) Cancellation Policy:
In the event of an Act of God, (e.g. fire, tornado, earthquake, mandatory evacuation due to hurricane) You will be issued a refund for the day(s) that you are required to evacuate. Refunds are ONLY ISSUED to guests in the event of a MANDATORY evacuation. Dependent upon unit location and storm path. REFUNDED ONLY for the UNUSED portion of the reservation. Meaning refunds for the days during which that location is under a mandatory evacuation notice.

The Atlantic Hurricane season runs from June 1st to November 30th. Should there be a mandatory evacuation notice. We will contact all guests with standing reservations. Please make sure you are watching the weather channel and staying updated with weather alerts. Should there be a mandatory evacuation. (Property Management) Staff will contact the guests and issue refunds as necessary.

PLEASE NOTE: Hurricanes are a serious natural disaster that are out of our control. Please plan accordingly as they can be life threatening. Feel free to contact us with any additional questions.

16.) WAIVER. Failure of Owner to enforce any provisions of this Agreement will not be deemed a waiver.

17.) ENTIRE AGREEMENT. The foregoing constitutes the entire agreement between the parties.

Upon receipt of your acceptance and first payment received from guest to VacationCentralFlorida, LLC. Your dates are guaranteed for you. In the event of an Act of God, (e.g. fire, mandatory evacuation due to hurricane) You will be issued a refund for the day(s) that you are required to evacuate. I (we) agree maintain the property in the same condition in which it was found.

I (we) agree to replace or pay for losses, breakage or damage should such occur, and to abide by all parts of the above agreement. By purchasing a vacation rental for your selected dates. You hereby agree to all rules and policies outlined in the agreement above.
